II. GENE­RAL INFOR­MA­TI­ON ON DATA PROCESSING

1. Scope of the pro­ces­sing of per­so­nal data

As a mat­ter of prin­ci­ple, we pro­cess our users’ per­so­nal data only to the ext­ent neces­sa­ry to pro­vi­de a func­tion­al web­site and our con­tents and ser­vices. The regu­lar pro­ces­sing of our users’ per­so­nal data only takes place with the con­sent of the user. An excep­ti­on is made in tho­se cases whe­re pri­or con­sent can­not be obtai­ned for fac­tu­al reasons and pro­ces­sing of the data is per­mit­ted by law.

2. Legal basis for the pro­ces­sing of per­so­nal data

Inso­far as we obtain the con­sent of the data sub­ject for the pro­ces­sing of per­so­nal data, Art. 6 para. 1 lit. the EU Data Pro­tec­tion Regu­la­ti­on (GDPR) ser­ves as the legal basis.

When pro­ces­sing per­so­nal data neces­sa­ry for the per­for­mance of a con­tract to which the data sub­ject is a par­ty, Artic­le 6 para­graph 1 let­ter b GDPR ser­ves as the legal basis. This also appli­es to pro­ces­sing ope­ra­ti­ons neces­sa­ry for the imple­men­ta­ti­on of pre-con­trac­tu­al measures.

Inso­far as the pro­ces­sing of per­so­nal data is neces­sa­ry to ful­fil a legal obli­ga­ti­on to which our com­pa­ny is sub­ject, Art.6 para.1 lit.c GDPR ser­ves as the legal basis.

In cases whe­re vital inte­rests of the data sub­ject or ano­ther natu­ral per­son requi­re the pro­ces­sing of per­so­nal data, Art.6 para. 1 lit.d GDPR ser­ves as the legal basis.

If the pro­ces­sing is neces­sa­ry to safe­guard a legi­ti­ma­te inte­rest of our com­pa­ny or of a third par­ty and if the inte­rests, fun­da­men­tal rights and free­doms of the data sub­ject do not out­weigh the for­mer inte­rest, Art.6 para. 1 lit.f GDPR ser­ves as the legal basis for the processing.

3. Data dele­ti­on and sto­rage duration

The per­so­nal data of the data sub­ject will be dele­ted or blo­cked as soon as the pur­po­se of the sto­rage no lon­ger appli­es. Sto­rage may also take place if this has been pro­vi­ded for by the Euro­pean or natio­nal legis­la­tor in EU regu­la­ti­ons, laws or other regu­la­ti­ons to which tho­se respon­si­ble are sub­ject. The data will also be blo­cked or dele­ted if a sto­rage peri­od pre­scri­bed by the abo­ve-men­tio­ned stan­dards expi­res, unless the­re is a need for fur­ther sto­rage of the data in order to con­clude or ful­fil a contract.

III. PRO­VI­SI­ON OF THE WEB­SITE AND CREA­TI­ON OF LOG FILES

1. Descrip­ti­on and scope of data processing

Each time our web­site is visi­ted, our sys­tem auto­ma­ti­cal­ly coll­ects data and infor­ma­ti­on from the visitor’s com­pu­ter system.

The fol­lo­wing data is collected:

  • the name of your ser­vice pro­vi­der (IP address)
  • the web page that led you to our website
  • the pages viewed
  • the brow­ser used
  • the date and dura­ti­on of the visit

The data is also stored in our sys­tem log files. This data is not stored tog­e­ther with other user per­so­nal data.

 

2. Legal basis for data processing

 

The legal basis for the tem­po­ra­ry sto­rage of data and log files is Art.6 para.1 lit.f GDPR.

3. Pur­po­se of the data processing

The tem­po­ra­ry sto­rage of the IP address by the sys­tem is neces­sa­ry to enable the web­site to be deli­ver­ed to the user’s com­pu­ter. For this pur­po­se, the user’s IP address must remain stored for the dura­ti­on of the session.

It is neces­sa­ry to store the user’s IP address in log files to ensu­re the func­tion­a­li­ty of the web­site. The data also enables us to opti­mi­se the web­site and to ensu­re the secu­ri­ty of our infor­ma­ti­on tech­no­lo­gy sys­tems. No eva­lua­ti­on of the data is car­ri­ed out for mar­ke­ting pur­po­ses in this context.

The­se pur­po­ses also include our legi­ti­ma­te inte­rest in data pro­ces­sing in accordance with Art.6 para.1 lit.f GDPR.

4. Dura­ti­on of storage

The data will be dele­ted as soon as it is no lon­ger requi­red for the pur­po­se for which it was coll­ec­ted. In the case of the coll­ec­tion of data for the pro­vi­si­on of the web­site, dele­ti­on occurs when the respec­ti­ve ses­si­on has ended.

In the case of data sto­rage in log files, dele­ti­on takes place after seven days at the latest. Sto­rage of the data bey­ond this peri­od of time is pos­si­ble. In this case, the IP addres­ses of the users are dele­ted or dis­tor­ted so that it is no lon­ger pos­si­ble to assign the data to the cli­ent visi­ting the website.

5. Pos­si­bi­li­ty of objec­tion and reques­t­ing removal

The coll­ec­tion of data for the pro­vi­si­on of the web­site and the sto­rage of the data in log files is man­da­to­ry for the ope­ra­ti­on of the web­site. The­re is the­r­e­fo­re no pos­si­bi­li­ty of objec­tion on the part of the user.

IV. USE OF COOKIES

a) Descrip­ti­on and scope of data processing

Our web­site uses coo­kies. Coo­kies are text files that are stored in the Inter­net brow­ser or by the Inter­net brow­ser on the user’s com­pu­ter sys­tem. If a user visits a web­site, a coo­kie may be stored on the user’s ope­ra­ting sys­tem. This coo­kie con­ta­ins a cha­rac­te­ristic string of cha­rac­ters that allows the brow­ser to be uni­que­ly iden­ti­fied when you return to the website.

We use coo­kies to make our web­site more user-fri­end­ly. Some ele­ments of our web­site requi­re that the user’s brow­ser can be iden­ti­fied even after moving from one page to another.

We also use coo­kies on our web­site, which enable ana­ly­sis of the user’s sur­fing behaviour.

In this way the fol­lo­wing data can be transmitted:

  • Ente­red search terms
  • Fre­quen­cy of page views
  • Use of web­site functions

The user data coll­ec­ted in this way is pseud­ony­mi­sed by tech­ni­cal pre­cau­ti­ons. The­r­e­fo­re, it is no lon­ger pos­si­ble to assign the data to the visi­ting user. The data is not stored tog­e­ther with other user per­so­nal data.

b) Legal basis for data processing

The legal basis for the pro­ces­sing of per­so­nal data using coo­kies is Art.6 para.1 lit.f GDPR.

c) Pur­po­se of the data processing

The pur­po­se of using tech­ni­cal­ly neces­sa­ry coo­kies is to sim­pli­fy the use of web­sites for users. Some func­tions of our web­site can­not be offe­red wit­hout the use of coo­kies. For the­se func­tions it is neces­sa­ry that the brow­ser is reco­g­nis­ed even after moving from one page to another.

We requi­re coo­kies for the fol­lo­wing applications:

  • Trans­fer of lan­guage settings
  • Memo­ri­sing search terms

The user data coll­ec­ted through tech­ni­cal­ly neces­sa­ry coo­kies is not used to crea­te user profiles.

The ana­ly­sis coo­kies are used for the pur­po­se of impro­ving the qua­li­ty of our web­site and its con­tents. The ana­ly­sis coo­kies enable us to learn how the web­site is used and thus con­stant­ly opti­mi­se our offering.

The­se pur­po­ses also include our legi­ti­ma­te inte­rest in the pro­ces­sing of per­so­nal data in accordance with Art.6 para.1 lit.f GDPR.

If users do not want coo­kies to be stored on their com­pu­ter, they are asked to deac­ti­va­te the cor­re­spon­ding opti­on in the sys­tem set­tings of their brow­ser. Stored coo­kies can be dele­ted in the sys­tem set­tings of the brow­ser. The exclu­si­on of coo­kies can lead to func­tion­al rest­ric­tions of this online offering.

e) Dura­ti­on of sto­rage, objec­tion and rem­oval options

Coo­kies are stored on the user’s com­pu­ter and trans­mit­ted by the user to our site. The­r­e­fo­re, you as a user also have full con­trol over the use of coo­kies. By chan­ging the set­tings in your Inter­net brow­ser, you can deac­ti­va­te or rest­rict the trans­mis­si­on of coo­kies. Alre­a­dy stored coo­kies can be dele­ted at any time. This can also be done auto­ma­ti­cal­ly. If coo­kies are deac­ti­va­ted for our web­site, it is pos­si­ble that not all func­tions of the web­site can be used to their full extent.

V. CONT­ACT FORM AND EMAIL CONTACT

1. Descrip­ti­on and scope of data processing

On our web­site the­re is a cont­act form which can be used for elec­tro­nic cont­act. If a user takes advan­ta­ge of this opti­on, the data ente­red in the input field is trans­mit­ted to us and stored. This data includes:

  • Name and company
  • E‑Mail
  • Address, pos­tal code, town
  • Tele­pho­ne
  • Coun­try
  • Web­site
  • Cate­go­ry (reason)
  • Mes­sa­ge
  • Anne­xes

Your con­sent will be obtai­ned for the pro­ces­sing of the data during the sen­ding pro­cess and refe­rence will be made to this pri­va­cy policy.

Alter­na­tively, it is pos­si­ble to cont­act us via the email address pro­vi­ded. In this case the per­so­nal data of the user trans­mit­ted with the email will be stored.

In this con­text, the data will not be pas­sed on to third par­ties. The data will be used exclu­si­ve­ly for pro­ces­sing the conversation.

2. Legal basis for data processing

The legal basis for the pro­ces­sing of the data is Art.6 para.1 lit.a GDPR if the user has given his consent.

The legal basis for the pro­ces­sing of data trans­mit­ted in the cour­se of sen­ding an email is Art.6 para.1 lit.f GDPR. If the email cont­act aims at the con­clu­si­on of a con­tract, the addi­tio­nal legal basis for the pro­ces­sing is Art.6 para.1 lit.b GDPR.

3. Pur­po­se of the data processing

The pro­ces­sing of the per­so­nal data from the input field only enables us to pro­cess the estab­lish­ment of cont­act. In the case of your cont­ac­ting us by email, we also have a neces­sa­ry legi­ti­ma­te inte­rest in the pro­ces­sing of the data.

The other per­so­nal data pro­ces­sed during the sen­ding pro­cess ser­ves to pre­vent misu­se of the cont­act form and to ensu­re the secu­ri­ty of our infor­ma­ti­on tech­no­lo­gy systems.

4. Dura­ti­on of storage

The data will be dele­ted as soon as it is no lon­ger requi­red for the pur­po­se for which it was coll­ec­ted. For the per­so­nal data deri­ved from the input field of the cont­act form and data sent by email, this data will be dele­ted when the respec­ti­ve con­ver­sa­ti­on with the user has ended. The con­ver­sa­ti­on ends when it is clear from the cir­cum­s­tances that the mat­ter in ques­ti­on has been final­ly clarified.

The addi­tio­nal per­so­nal data coll­ec­ted during the sen­ding pro­cess will be dele­ted after a peri­od of seven days at the latest.

5. Pos­si­bi­li­ty of objec­tion and reques­t­ing removal

The user has the pos­si­bi­li­ty to revo­ke his con­sent to the pro­ces­sing of per­so­nal data at any time. For this pur­po­se an infor­mal com­mu­ni­ca­ti­on by email to us is suf­fi­ci­ent. The lega­li­ty of the data pro­ces­sing ope­ra­ti­ons car­ri­ed out up to the time of revo­ca­ti­on shall remain unaf­fec­ted by the revo­ca­ti­on. All per­so­nal data stored in the cour­se of the cont­act will be dele­ted in this case.

VI. WEB ANA­LY­SIS BY GOOG­LE ANALYTICS

We use Goog­le Ana­ly­tics, a web ana­ly­sis ser­vice of Goog­le LLC (“Goog­le”), on the basis of our legi­ti­ma­te inte­rests (i.e. inte­rest in the ana­ly­sis, opti­mi­sa­ti­on and eco­no­mic ope­ra­ti­on of our online offer within the mea­ning of Art. 6 para. 1 lit. f. GDPR). Goog­le uses coo­kies. The infor­ma­ti­on gene­ra­ted by the coo­kie con­cer­ning the use of the online offe­ring by the user is usual­ly trans­fer­red to a Goog­le ser­ver in the USA and stored there. 

Goog­le is cer­ti­fied under the Pri­va­cy Shield Agree­ment and thus offers a gua­ran­tee to com­ply with Euro­pean data pro­tec­tion law (https://www.privacyshield.gov/participant?id=a2zt000000001L5AAI&status=Active).

Goog­le will use this infor­ma­ti­on on our behalf to eva­lua­te the use of our web­site by users, to com­pi­le reports on the acti­vi­ties within this web­site and to pro­vi­de us with fur­ther ser­vices asso­cia­ted with the use of this web­site and the Inter­net. Pseud­ony­mous user pro­files of the users can be crea­ted from the pro­ces­sed data. 

We only use Goog­le Ana­ly­tics with acti­va­ted IP anony­mi­sa­ti­on. This means that the IP address of users is trun­ca­ted by Goog­le within mem­ber sta­tes of the Euro­pean Uni­on or in other sta­tes that are par­ty to the Agree­ment on the Euro­pean Eco­no­mic Area. Only in excep­tio­nal cases is the full IP address trans­fer­red to a Goog­le ser­ver in the USA and trun­ca­ted there. 

The IP address trans­mit­ted by the user’s brow­ser is not com­bi­ned with other data from Goog­le. Users can pre­vent the sto­rage of coo­kies by adjus­ting their brow­ser soft­ware accor­din­gly; users can also pre­vent the coll­ec­tion of data gene­ra­ted by the coo­kie and rela­ted to their use of the web­site to Goog­le and the pro­ces­sing of this data by Goog­le by down­loa­ding and instal­ling the brow­ser plug-in available at the fol­lo­wing link:http://tools.google.com/dlpage/gaoptout?hl=de.

Fur­ther infor­ma­ti­on on the use of data by Goog­le, set­ting and objec­tion pos­si­bi­li­ties, can be found in the Goog­le pri­va­cy poli­cy (https://policies.google.com/technologies/ads) as well as in the set­tings for the dis­play of adver­ti­sing by Goog­le (https://adssettings.google.com/authenticated).

The per­so­nal data of the users will be dele­ted or made anony­mous after 14 months.

We inte­gra­te the vide­os of the “You­Tube” plat­form of the pro­vi­der Goog­le LLC, 1600 Amphi­theat­re Park­way, Moun­tain View, CA 94043, USA. Pri­va­cy poli­cy https://www.google.com/policies/privacy/,Opt-out https://adssettings.google.com/authenticated.

VIII. RIGHTS OF THE DATA SUBJECT

You have the right to obtain con­fir­ma­ti­on as to whe­ther or not data in ques­ti­on is being pro­ces­sed and to obtain infor­ma­ti­on about this data and to recei­ve fur­ther infor­ma­ti­on and a copy of the data in accordance with Art. 15 GDPR. 

In accordance with Art. 16 GDPR gives you the right to request the com­ple­ti­on of data con­cer­ning you or the cor­rec­tion of incor­rect data con­cer­ning you. 

In accordance with Art. 17 GDPR, you have the right to demand that the data in ques­ti­on be dele­ted imme­dia­te­ly, or alter­na­tively, in accordance with Art. 18 GDPR, to demand that the pro­ces­sing of the data be restricted. 

You have the right to request that the data con­cer­ning you which you have pro­vi­ded us with be made available to us in accordance with Art. 20 GDPR and to demand that it be pas­sed on to other respon­si­ble persons. 

Under Art. 77 GDPR, you also have the right to lodge a com­plaint with the com­pe­tent super­vi­so­ry authority. 

a. Right of withdrawal 
You have the right to revo­ke cons­ents gran­ted in accordance with Art. 7 Para. 3 GDPR with effect for the future 

b. Right of objection 
You can object to the future pro­ces­sing of data con­cer­ning you at any time in accordance with Art. 21 GDPR. The objec­tion may be made in par­ti­cu­lar against pro­ces­sing for the pur­po­ses of direct marketing.
